What has to be taken notice of buying a real estate
1) May I buy a real estate in Turkey?
Because of bilateral arrangements foreigners from following countries may purchase a real estate in Turkey: Germany,
Australia, Austria, Belgium, France, Netherlands, England, Ireland, Spain, Italy, USA, Canada, Luxemburg and a few
african and south-american states.
2) What do I have to take notice of?
Before closing a contract has to be examined
- whether the object of the selling person is really his own - the "Tapu" (title) is not proof to be the owner of the property!!!
whether the title register consists of mortgage, seizure or long lasting rent or lease contracts
whether the object is located within municipalty limits (only there foreigners may purchase)
3) How much is the purcase tax on the real estate? Which other costs are aside?
The purchase tax and fee is around 3,5 % of the declared price. Furthermore costs are not in current.
4) How much is a notary?
Nothing. In Turkey there is no need for a notary, to purchase a real estate.
You yust have to go to the land registry office and apply for transcription.
5) Can I sell or leave my real estate?
You can sell your real estate at anytime and take the money with you or transfer. In case of death the rear estate goes to your
legal heir (if you did not dispose something different).
6) How long do I have to wait for the registrationat land registry?
A sale to a foreigner takes up to 3 month, because the local land registry office has to get a written confirmation from the
supra-regional military administration, that the object is not located in military catchment area. This is a formality. When
the answer has come, the transcription is done within one day.A sworn translator has to be present. If you purchase an
object from a community (Kooperatif), you can become registered as owner immediately at the administration of the
community. This way your rights are protected similar to the registration at the land registry office. As soon as the
community concludes to cancel your status, she applies for all members the registration at land registry office.
7) How much is the annual real estate tax?
The annual real estate tax is 3/1000 of the declared value and
has to be paid to the municipalty every year.
8) How much is the brokers fee?
The legal layed down brokers fee for purchaser and seller is 3% each.
